Introduction

These Terms of Service ("Terms") govern your use of CacheTank, a portable AI context layer provided by July Blue Sky LLC ("Company," "we," "us," or "our"). By accessing or using CacheTank, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use CacheTank.

Service Description

CacheTank is a platform that allows you to save, organize, and access your personal context across multiple AI tools and platforms. The service is provided on an as-is basis and includes:

  • Free Tier: 30 saves per month at no cost
  • Pro Tier: Unlimited saves at $2 per week (weekly billing)
  • Team Tier: Shared organization and multi-user access at $8 per week (weekly billing)

Account Registration & Eligibility

To use CacheTank, you must:

  • Be at least 18 years old
  • Have a valid email address
  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your account credentials
  • Be responsible for all activities under your account

You agree to notify us immediately of any unauthorized use of your account.

Subscription & Billing

Weekly Billing

Pro and Team plans are billed weekly. Your subscription renews automatically every 7 days unless you pause or cancel.

Pause Anytime — Never Cancel

You can pause your subscription at any time. While paused, you will not be charged. Your data remains accessible if you reactivate. We never use harsh cancellation language or require lengthy contact processes. Pausing is simple and reversible.

Payment Methods

We accept payments via Stripe. By providing payment information, you authorize us to charge your chosen method according to your subscription tier.

Billing Disputes

If you dispute a charge, contact us within 30 days of the transaction. We will investigate and issue a refund if appropriate.

Free Tier

The Free Tier includes 30 saves per month with no card required and no hidden charges.

Acceptable Use

You agree not to use CacheTank for:

  • Illegal or unlawful purposes
  • Harassment, abuse, or threats directed at others
  • Distributing malware, viruses, or malicious code
  • Attempting to gain unauthorized access to our systems
  • Reverse engineering, decompiling, or disassembling the service
  • Reselling or redistributing CacheTank without authorization
  • Violating others' intellectual property rights
  • Storing or transmitting content that is explicitly illegal in your jurisdiction

We reserve the right to suspend or terminate your account if you violate these terms.

Data Ownership & User Content

Your Content Is Yours

All data, documents, preferences, and content you save to CacheTank ("User Content") belongs entirely to you. You retain full ownership, copyright, and intellectual property rights to everything you upload or create.

License to CacheTank

By uploading content to CacheTank, you grant us a limited, non-exclusive license to:

  • Store your content securely
  • Retrieve and display your content to you
  • Make your content accessible via your personal URL
  • Back up your content for disaster recovery and data integrity

No AI Training on User Data

We explicitly do not use your saved content to train, improve, or develop AI models. Your context is not fed into LLMs for training purposes. Your data remains your property and is not monetized for training.

CacheTank Owns the System

While you own your content, CacheTank owns the system, software, organizational framework, algorithms, and features that make CacheTank work. This includes the filing system, search functionality, encryption protocols, and user interface.

Intellectual Property

CacheTank, its name, logo, design, features, and all underlying code are protected by copyright and intellectual property laws. You may not copy, modify, or distribute any part of CacheTank without explicit written permission.

The CacheTank service is licensed to you for personal, non-commercial use. You may not sell, rent, lease, transfer, assign, sublicense, or otherwise transfer the service to third parties.

Limitation of Liability

To the fullest extent permitted by law, CacheTank and July Blue Sky LLC shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of data, profits, revenue, or business opportunities
  • Damages arising from service interruptions or downtime
  • Damages from unauthorized access or data breaches (despite reasonable security measures)
  • Any damages exceeding the total amount you paid us in the 12 months prior to the claim

CacheTank provides the service "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service or error-free operation.

Indemnification

You agree to indemnify, defend, and hold harmless CacheTank and July Blue Sky LLC from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of CacheTank in violation of these Terms
  • Your User Content infringing on others' rights
  • Your violation of applicable laws
  • Your infringement of third-party intellectual property rights

Termination & Account Deletion

Termination by You

You may delete your account at any time through your dashboard or by contacting support. Upon deletion:

  • Your account is immediately closed
  • Billing stops immediately
  • Your personal data is deleted within 30 days
  • Files are retained for 90 days (accessible if you reactivate) or archived permanently

Termination by CacheTank

We may suspend or terminate your account immediately if you:

  • Violate these Terms of Service
  • Engage in illegal activity
  • Abuse the service or other users
  • Fail to pay for a paid subscription after 30 days

Upon termination by us, you will have 30 days to download your data. After 30 days, we may delete your account and data.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts located in Delaware.

Dispute Resolution

Before pursuing legal action, you agree to attempt to resolve disputes through good-faith negotiation with our support team. If negotiation fails, you agree to binding arbitration in accordance with Delaware law rather than court proceedings.

Service Availability & Maintenance

While we strive for maximum uptime, we do not guarantee uninterrupted service. We may perform scheduled maintenance, updates, and improvements that may temporarily interrupt service. We will provide notice when possible.

We are not liable for any downtime, data loss, or service interruptions during maintenance or due to circumstances beyond our reasonable control (including infrastructure failures, DDoS attacks, or natural disasters).

Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of CacheTank after changes constitutes acceptance of the updated Terms.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and CacheTank regarding the service. Any previous agreements or understandings are superseded by these Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
